Public invitation for NGOs to propose a representative for a member of the Rule of Law Council

During the talks held by the Prime Minister of Montenegro in February 2019 with representatives of non-governmental organizations under the “Alliance for Europe initiative”, initiated through a wide dialogue with relevant political and social actors to raise all issues relevant to overcoming divisions, and all with a view to the full integration of Montenegro into the EU, and in accordance with Article 3 of the Decree on the election of representatives of non-governmental organizations to the working bodies of the state administration and conducting a public debate in the preparation of laws and strategies (Official Gazette of Montenegro 41/18), with the Decision on the Council for the Rule of Law (Official Gazette of Montenegro 36/19 and 46/19), the Office for European Integration in the Cabinet of the Prime Minister of Montenegro announces:

NGOs to propose

a representative for a member of the Rule of Law Council

The Office for European Integration in the Cabinet of the Prime Minister of Montenegro invites non-governmental organizations to submit proposals for the election of representatives to the Council for the Rule of Law.

A non-governmental organization may nominate only one representative for a member of the Rule of Law Council.

The tasks of the Rule of Law Council are:

  • monitoring the implementation of the obligations of Chapter 23 – Justice and Fundamental Rights and 24 – Justice, Freedom and Security in the process of Montenegro’s accession to the European Union, in accordance with the recommendations of the Chief Negotiator and the negotiating group member of Montenegro for the accession of Montenegro to the chapters of negotiations 23 – Justice and fundamental rights and 24 – Justice, freedom and security;
  • monitoring the implementation of commitments to meet the provisional benchmarks in Chapters 23 – Justice and Fundamental Rights and 24 – Justice, Freedom and Security;
  • monitoring the implementation of obligations in order to meet the closing benchmarks in Chapters 23 – Justice and Fundamental Rights and 24 – Justice, Freedom and Security;
  • reviewing the reasons for the delay in the implementation of obligations and making recommendations to state authorities, state administration bodies and other emergency authorities and institutions in order to fulfil the obligations of Chapter 23 – Justice and Fundamental Rights and 24 – Justice, Freedom and Security and
  • carrying out other tasks, in accordance with the Decision on establishing a structure for negotiations on the accession of Montenegro to the European Union.

Criteria for a non-governmental organization that can nominate a representative in the working body:

  • that it has been registered in the register of non-governmental organizations prior to the announcement of the public invitation;
  • that the statute has defined activities and goals in the areas related to issues that are considered or regulated by the working body;
  • not on the criminal record register;
  • that in the last three years, in relation to an issue that is considered or normatively regulated by a working body, it has conducted a research, produced a document, organized a gathering or implemented a project aimed at improving the situation in a particular field;
  • submitted to the tax authority an application for the previous fiscal year (a photocopy of the balance sheet and income statement);
  • that more than half of the members of the governing bodies of a non-governmental organization are not members of political party bodies, public officials, executives or civil servants or state employees.

Criteria to be met by the NGO representative in the working body:

  • • is domiciled in Montenegro;
  • • have experience in the work of working groups to prepare and conduct negotiations on the accession of Montenegro to the European Union for the acquis communautaire relating to the negotiation chapter 23 – Justice and Fundamental Rights and Negotiation Chapter 24 – Justice, Freedom and Security;
  • • have experience in a relevant field that is considered or regulated by a working body;
  • • that he / she is not a member of a political party body, a public official, a civil servant, or an employee.

The nomination of NGO representatives is made on Form 2 prescribed by the Regulation on the election of NGO representatives to the working bodies of state administration bodies and the conduct of public hearings in the preparation of laws and strategies, which can be downloaded here.

Documentation to be submitted with the proposal of the NGO representative in the working body:

  • proof that the non-governmental organization is registered in the register of non-governmental organizations (photocopy);
  • a photocopy of the statute of the NGO;
  • evidence that in the past three years a non-governmental organization, in relation to a matter that is considered or normatively regulated by a working body, conducted a research, produced a document, organized a meeting or implemented a project aimed at improving the situation in a particular area, signed by a person authorized to represent and confirmed by the NGO seal;
  • Evidence that the NGO submitted to the tax authority a report for the previous fiscal year (photocopy of the income statement);
  • statement of the person authorized to represent the non-governmental organization that more than half of the members of the governing body of the non-governmental organization are not members of the bodies of political parties, public officials, executives or civil servants or state employees;
  • a photocopy of the identity card or other public document that can be used to establish the identity of the NGO representative in the working body;
  • biography of NGO representatives in the working body;
  • evidence of the experience of a non-governmental organization representative in the area covered by a matter that is considered or normatively regulated by the working body (professional work, certificate or other document);
  • Statement by a representative of a non-governmental organization in a working body that he or she is not a member of a political party body, a public official, a leading person or a civil servant, or an employee;
  • Statement by the NGO representative that he / she accepts that the NGO proposes him / her as a representative in the working body.

The deadline for submission of proposals by representatives of non-governmental organizations is ten days from the date of publication of this invitation on the Government’s web site and e-government portal.

Documents by public invitation shall be submitted to the archives of the Office for European Integration in the Cabinet of the Prime Minister of Montenegro, at the following address:

The proposal of a candidate for a member of the Council for the Rule of Law will only be considered if it is submitted with all the necessary documentation and within the specified deadline.

The Office for European Integration in the Cabinet of the Prime Minister of Montenegro will, within seven days from the expiry of the deadline for submitting nominations of candidates, publish on its website a list of candidates proposed for members of the Rule of Law Council, with names the NGOs who proposed them.

Based on the results of the call, the Office for European Integration will include three representatives of non-governmental organizations in the Rule of Law Council.
